    Please read the following terms and conditions (the "Terms and Conditions") carefully before using the website. The Terms and Conditions explain what you can, and cannot, do when accessing and using the Website. By accessing and using the Website, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not access or use the Website. These Terms and Conditions should be read in conjunction with the Legal Statement and Disclaimer and the Privacy Policy.
  2. Definitions (honestly you don't need a dictionary!)

    "Content" means any and all material available on the Website.
    "Legal Statement and Disclaimer" means the legal statement and disclaimer relating to the Website which is published on the Website.
    "Privacy Policy" means the privacy policy relating to the Website which is published on the Website.
    "Services" has the meaning given to that term at paragraph 3 below.

    "we" and "us" means RaboDirect and Brando.

    The Website allows Users to post content in the form of truths and comments on-line, view online content, watch television advertisements via YouTube, watch web videos, rate web videos and advertisements, avail of social bookmarking services, forward certain content to friends and access RaboDirect's website, www.rabodirect.ie (as amended, withdrawn or supplemented from time to time, the "Services"). We reserve the right to amend and/or withdraw all or part of the Services at any time, and to added new elements to the Services at any time. If and when any new elements are added to the Services, these Terms and Conditions shall apply equally to those new elements. (In other words it is our website and we can change it if we like.)

  5. Information about you and your visits to the Website

    1. You may access all areas of the Website without registering your details with us however, to receive email notification of any comments on the truth(s) posted by you, you must provide your contact email address to us.
    2. We will process information about you in accordance with our Privacy Policy. By using the Website, you consent to such processing. (We promise to keep your personal data safe.)
  6. Suspension or termination of your use of the Website

    1. We retain sole discretion as to whether truths or comments submitted for posting will actually be published on the Website. (We are not really into publishing truths about three legged sheep but you never know.)
    2. We also retain sole discretion as to whether to delete or remove any truths or comments posted on the Website. (No bad language allowed ok?)
  7. Responsibility

    1. You agree that all Content posted to or privately transmitted from the Website by Users is the sole responsibility of the User from whom that Content originated. You agree that we do not take any responsibility for or represent or warrant any such Content. (Remember be careful what you admit to!)
    2. You acknowledge that all copyright, trademarks and all other intellectual property rights arising out of the Website and the Content vest in RaboDirect but not in you or any other User.
    3. You acknowledge that you are only permitted to use the copy, reproduce, transmit, distribute or create derivative works of such material. (Hands off the loot unless we say you can use it.)
    4. You agree, when submitting truths or comments to the Website, that you will not impersonate any other person or entity or use a false name that you are not authorised to use. (Just be yourself!)
    5. You may not use the Website for any illegal or unlawful purpose. You may not use the Website in a manner which could interfere with another party's use or enjoyment of the Website, or in a manner which could damage the Website. (This is meant to be a fun space so let's try and keep it that way...)
    6. You agree not to use any of the Services to create, host or transmit any material which is defamatory, offensive, obscene or which infringes the copyright of any other party or engage in activities which would cause offence to others on any grounds. (We don't want to hurt anyone's feelings.)
    7. You may not use any of the Services to transmit unsolicited advertising material to other users. (No one likes email spam do they? Although we hear canned Spam is making a comeback if you're hungry.)
    8. The Website enables access to material that is protected by copyright, trade mark and other relevant intellectual property rights. You may only use the Services and the Content for private and personal use, and not for any commercial purposes or in any way that may infringe the rights of others. You must comply with all other instructions regarding use of the Services and the Content. Otherwise than in accordance with authorisation from us you shall not store, modify, transmit, distribute, broadcast or publish any part of the Content. The re-selling, copying or incorporation into any work of part or all of the Content in any form is prohibited. (This is the long way of saying not to steal any of the Content.)
    9. You may not link to the Website in a way that damages or takes advantage of our respective reputations or suggests any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.

The inclusion of links to such sites does not imply any endorsement of the material on such sites or any associations with their operators. (Just because we provide links to other websites doesn't mean that they are any good.)

However, due to the nature of interactive services, and of the internet generally, we cannot guarantee that the Website will be fault-free. Neither we nor any of our respective officers, employees, agents, accept any liability for any damage or loss suffered by you arising as a result of the Website, the Services, or the Content (including any errors, inaccuracies or omissions in the Content, or any faults, interruptions or delays in connection with the Website or the Services) or any transaction made in connection with the Website, Services or Content or in reliance on the Website, Services or Content. (If gremlins appear and disrupt the Website we will promise to fix it as soon as possible.)

While all reasonable efforts are made to ensure that any Content supplied by us (as opposed to Content supplied by Users of the Website) is correct, we make no representations or warranties, express or implied, in relation to the accuracy or completeness of that Content. (Sometimes even website owners get it wrong.)
    3. You acknowledge that we have no control over, and exclude liability for, any information on websites operated by third parties that can be accessed using the Website. (It's tough enough to manage our own website let alone someone else's.)

Except as expressly set out in these Terms and Conditions, all representations, warranties, terms and conditions, whether express or implied, in relation to the Website, the Services and the Content are hereby excluded to the fullest extent permitted by law. (Unless it's written here or required by law we're not responsible for anything to do with the Website.)

If we cannot do what we have promised to do under these Terms and Conditions or on the Website because of something beyond our reasonable control such as technical failure, lightening, flood or exceptionally severe weather, fire or explosion, civil disorder, war or military operations, natural or local emergency, the act or omission of other providers of internet services, we shall not have any liability to you. (Hey, it's not our fault if we get struck by lightning is it?)
  10. Indemnity

    You are responsible for any claims or legal proceedings arising from your use of the Website (including, but not limited to, claims in respect of defamation, breach of copyright or other intellectual property right infringement) which are brought or threatened against either or both of us by another person and shall ensure that we suffer no loss accordingly. (So be careful you don't get yourself into trouble.)

    1. Your access to the Website may occasionally be interrupted or restricted to allow for repairs or maintenance to be carried out, or for the introduction of new Services or facilities. We will endeavour to restore the Website as soon as possible. We may modify the Website at any time, with or without notice.

Such suspension or termination shall be without prejudice to any other rights that either of us may have against you in respect of any breach of these Terms and Conditions. (And we will make you open post in our post room if you're really bold.)

    1. Any delay or failure by either or both of us in enforcing these Terms and Conditions shall not constitute a waiver by either or both of us of our respective rights and/or remedies.
    2. If any part of these Terms and Conditions is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining parts of these Terms and Conditions will not be affected.
    3. We may modify these Terms and Conditions at any time, such modifications becoming effective immediately upon the uploading of the modified Terms and Conditions to the Website. By continuing to use the Website following uploading of the modified Terms and Conditions, you will be deemed to have agreed to those modified Terms and Conditions. (Hopefully you have read this part!)
    4. These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Both us and you hereby submit to the non-exclusive jurisdiction of the Irish courts.
